US Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her decision, the judge pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
